Gabriel Oni, a retired education director in Ikole Ekiti, Ekiti State has accused his wife of promiscuity and threat to life. Oni filed for divorce in March asking the Customary Court sitting in Ikole Ekiti to dissolve their 40-year-old marriage.
Oni, 74, told the court that his wife, Funmilayo had engaged in
extramarital affairs while they lived in Germany which necessitated his
sending her back to Nigeria in 1977.
According to him, they both reconciled and settled their differences
in 1987 when he finally relocated back to Nigeria. They later had two
more children after their first child which they gave birth to while in
Europe.
He said, “She again went back to her promiscuous ways which resulted in her having a child for my elder brother’s son.
“Aside being promiscuous, she’s also not humble and fights me always.
“She will threaten me in public, fight with my tenants, caretaker and claim ownership of my house,” he said.
Funmilayo, while responding, admitted that Gabriel sent her back to
Nigeria from Germany in 1977 on allegation of adultery, but denied ever
being involved in such.
She denied her husband’s claims that their fourth child belongs to
her in-laws son saying the child belongs to Gabriel. She, however,
admitted committing adultery with Gabriel’s brother’s son.
She prayed the court to grant her one apartment in the house built by
her husband to enable her live there with their children as she had
nowhere to go.
In her judgment, the court president, Mrs Yemisi Ojo, declared that
Gabriel had successfully proved that the marriage to his wife had
broken down irretrievably and thus, dissolved their marriage.
“On the issue of paternity of the fourth child which the plaintiff
sought declaration on, this was not one of the plaintiff’s prayers
before the court when he originally filed his claim,” she stated.
Ojo, in her judgment, accorded Funmilayo the privilege to continue
living in the apartment she is currently occupying with her children in
her husband’s house for the rest of her life.
